What you need to know about the state of emergency and tightening COVID-19 curbs in Malaysia - CNA

KUALA LUMPUR: Malaysia has entered a state of emergency. It will last until Aug 1 or earlier depending on the state of coronavirus infections, a statement from the palace said.

The king’s proclamation on the state of emergency on Tuesday morning (Jan 12) came amid an alarming rise of COVID-19 cases in Malaysia, with the national total surpassing 138,000 and the healthcare system at a breaking point. 

On Monday, the government announced the tightening of COVID-19 restrictions, placing five states and three federal territories under the Movement Control Order (MCO) again for two weeks

Prime Minister Muhyiddin Yassin stressed in his live address on Tuesday morning that this state of emergency is not a military coup and no curfew will be enforced. 

The prime minister said economic activities will continue to take place and people can continue to work while business, trade and industries can operate as usual, with adherence to standard operating procedures.

“To all the stakeholders keenly monitoring what is happening in Malaysia, I emphasise that Malaysia is open for business. 

“In facing these challenging times, this period of emergency will give us much needed calm and stability, as well as enable us to focus on economic recovery and regeneration. We remain committed to good governance in these times and we have a robust and dynamic regulatory ecosystem,” Mr Muhyiddin said. 

Here’s what we know so far: 

WHAT IS A STATE OF EMERGENCY IN MALAYSIA'S CONTEXT?

Article 150(1) of the Constitution stipulates that if the Malaysian king is satisfied that a grave emergency exists, whereby the security, or the economic life, or public order in the federation or any part thereof is threatened, he may issue a proclamation of emergency. 

The last time a nationwide state of emergency was invoked was in 1969 due to the May 13 riots. A curfew was declared and the parliamentary rule was later re-established in February 1971. 

The current COVID-19 pandemic has presented a great threat to the economic life of the people, thus warranting a state of emergency, said Mr Muhyiddin in his Tuesday address.

During the period, the parliament and state legislative assemblies will not sit until a time decided by the king, he added.

The prime minister assured the people that the state of emergency does not mean a military coup and there will not be a curfew.

The Cabinet and the state executive councils will continue to function, the prime minister added. 

“I assure you that the administrative and public service machineries of the federal and state governments will not be affected by this declaration of emergency,” he added. 

WHAT CAN HAPPEN DURING A STATE OF EMERGENCY?

To curb the spread of COVID-19, the king can proclaim several emergency ordinances on matters related to private hospital assets; temporary ownership of land, buildings or moveable properties of private hospitals; or to request to use the resources of private hospitals to treat patients, according to Mr Muhyiddin. 

The government can also seek a more inclusive involvement from the private sector including private healthcare facilities to help ease the burden of government agencies, especially public hospitals, he added. 

“Through this ordinance, assistance that can be obtained from the private sector covers human resources, expertise, facilities, assets, laboratories and utilities,” he said.

An ordinance can also be promulgated to allocate enforcement powers to the armed forces. In line with the proclamation of the state of emergency, border control will be tightened through empowering military personnel to arrest illegal immigrants and anyone who breaches national borders. 

Additionally, the penalty for those who violate the laws and regulations related to the control of the COVID-19 pandemic can be increased by enacting an ordinance to amend the Prevention and Control of Infectious Diseases Act 1988. This move could enhance the effectiveness of enforcement, Mr Muhyiddin said.

Ordinances aimed at combating economic sabotage, monopoly and excessive increase of prices of goods can also be proclaimed by the king, with stricter enforcement actions and heavier penalties to be imposed.  

WILL THERE BE ELECTIONS? 

General election, state election and by-election will not be held during the emergency, Mr Muhyiddin said.  

On some parties urging for a general election to be held, the prime minister said it is not his intention to not call for the general election. 

The COVID-19 pandemic is the main issue stopping him from advising the king to dissolve the parliament and pave the way for the election, he said. 

An independent special committee will be established under an ordinance to advise the king on whether a major emergency still occurs, in order to decide to continue the period of emergency or terminate the proclamation earlier than the date designated.

“I give a firm commitment that a general election will be held as soon as the independent special committee to be established certifies that the COVID-19 pandemic has subsided or fully recovered, and elections are safe to be held. 

“When the time comes, it is up to the people to choose which government is qualified to govern this country and take care of your welfare,” he said.

Mr Myhyiddin said it is very important for politicians to set aside their differences and stand in solidarity with the people. 

He also gave his assurance that the judiciary system will continue to function during the state of emergency. 

“The judiciary will continue to be the beacon of justice in our country and I will never interfere in the business of the court,” he said.

WHAT WE KNOW ABOUT THE MCO'S PROTOCOLS SO FAR

Five states, including Penang, Selangor, Melaka, Johor and Sabah, and the federal territories of Kuala Lumpur, Putrajaya and Labuan will be placed under MCO again from Wednesday until Jan 26. 

Interstate travel is banned across the country, while travelling between districts is not allowed for the states under MCO.

In his Monday address, Mr Muhyiddin said social activities such as wedding receptions, conferences, religious gatherings, seminars, courses and mass sports are not allowed.

Another six states - Pahang, Perak, Negeri Sembilan, Kedah, Terengganu and Kelantan - will be placed under conditional MCO (CMCO), while Perlis and Sarawak are under the recovery MCO (RMCO).

For those under MCO, only two people per family are permitted to leave home to purchase daily necessities and their movement is limited to a 10km radius. 

Eateries and hawker stalls are only allowed to open for takeaways in MCO states, while those in CMCO and RMCO states can operate with adherence to SOPs.

With new school year slated to begin on Jan 20, the Education Ministry has announced that only students sitting for major school leaving examinations will return to schools in MCO areas. 

For these states and territories, primary school pupils and those in Secondary 1 to 4 will continue learning from home. 

Education institutions in CMCO and RMCO states will operate according to their respective academic calendars, the ministry added. 

More implementation details are expected to be announced by the authorities.

WHAT ARE THE PROTOCOLS FOR BUSINESSES DURING MCO?

In a statement issued on Tuesday in response to the reinstatement of MCO, Senior Minister for Economy Mohamed Azmin Ali said these five states and three federal territories are the main drivers of the country’s economic activities and major contributors to gross domestic product (GDP). 

In total, they account for 66.3 per cent of the total GDP, he said. 

The government’s decision to allow five essential economic sectors - manufacturing, construction, services, trade and distribution sectors, as well as plantations and commodities - to operate in these places is to ensure the country’s economic recovery process, business sustainability and avoid high unemployment rates, he said. 

This will also ensure that people continue to have access to basic and critical necessities, Mr Mohamed Azmin, who is also the Minister for International Trade and Industry, said. 

Only 30 per cent of employees in the management group are allowed in the office, he added. 

"The number of support staff and employees directly involved in the production line will be determined by their respective employers, taking into account strict compliance to the SOPs," the minister said. 

The Work From Home (WFM) direction will also apply for work that does not require physical attendance. 

"The government calls on the industry and the private sector to enhance the implementation of WFH as a new norm, in line with the advances of the latest technologies and online applications," the minister said. 

The minister said the proactive action by the government will have a positive impact on the country's economic growth, local and foreign investment flows as well as the sustainability of small- and medium-size enterprises.

Trump, Pence signal common front with Oval Office meeting - CNA

WASHINGTON: United States President Donald Trump and his deputy Mike Pence met on Monday (Jan 11) evening in the Oval Office, a senior official said, signalling a common front as Democrats press the vice president to have the president removed from office as unfit.

"The two had a good conversation," the administration official said of the meeting, their first since last week's assault on the US Capitol.

According to the official, Trump has no intention of resigning his office before his term comes to an end on Jan 20.

The official likewise indicated that Pence has no intention of invoking the 25th Amendment of the Constitution to remove Trump as unfit to discharge his duties - as Democrats are demanding.

Trump and Pence "reiterated that those who broke the law and stormed the Capitol last week do not represent the America first movement backed by 75 million Americans", the official said.

The pair "pledged to continue the work on behalf of the country for the remainder of their term", they added.

The House of Representatives is scheduled to vote on Tuesday evening on a resolution calling for Pence to invoke the 25th Amendment, and Pelosi will give him 24 hours to respond.

After that, she said, Democrats would move forward with the process of impeaching Trump for "incitement of insurrection" over his role in last Wednesday's storming of the US Capitol by his supporters.

In an angry speech before the assault, Trump urged his supporters to march to the Capitol and demand that Pence, who was leading a joint session of Congress on certifying Joe Biden's victory, must intervene to reverse his election defeat.

Pence refused, and he was ultimately the one who announced to lawmakers Trump's and his loss to Biden and Kamala Harris, the incoming vice president.

Some Trump supporters, furious over Pence's action, were chanting that he should be hanged.

KUALA LUMPUR - Malaysia has declared a national emergency to battle the coronavirus pandemic that has killed as many people this year as the whole of 2020.

The Palace said on Tuesday (Jan 12) that King Abdullah Ahmad Shah has assented to the government's request for an emergency order that will be effective up to Aug 1, or earlier should Covid-19 cases come under control.

"Al-Sultan Abdullah is of the view that the spread of Covid-19 in the country is at a very critical stage and there is need to decree an Emergency Proclamation," the royal comptroller Ahmad Fadil Shamsuddin said in a press statement.

This confirms The Straits Times' report on Monday (Jan 11) that Cabinet had met to revive the emergency proposal that had initially been rejected by the King in October.

The situation in the country has since changed.

Noting that the number of beds and intensive care slots at hospitals for Covid-19 patients were nearly full, Sultan Abdullah of Pahang approved the emergency powers for the administration of Prime Minister Muhyiddin Yassin as a "proactive move".

US Democrats move to impeach Trump in final days of presidency - CNA

WASHINGTON: Congressional Democrats on Monday (Jan 11) formally began the process of impeaching President Donald Trump for a historic second time, accusing him of "incitement of insurrection" over his supporters' deadly storming of the US Capitol.

The move - which threatens to torpedo the single-term president's future political ambitions - could make for a frenetic culmination of four years of controversy ahead of Joe Biden's Jan 20 inauguration.

Democrats introduced a resolution in the House of Representatives calling for Vice President Mike Pence and the cabinet to remove Trump as unfit for office under the US Constitution's 25th Amendment.

But Republicans blocked its immediate adoption and Democrats followed up by introducing an article of impeachment of Trump for "incitement of insurrection".

Speaker Nancy Pelosi hit out at House Republicans, accusing them of enabling Trump's "unhinged, unstable and deranged acts of sedition to continue."

"Their complicity endangers America, erodes our Democracy, and it must end," she said in a statement.

The House is now scheduled to vote on Tuesday evening on the demand for Pence to invoke the 25th Amendment, and Pelosi will give him 24 hours to respond.

After that, she said, Democrats would move forward with an impeachment vote.

Biden has not publicly backed impeachment. But in Delaware, where the president-elect was receiving his second dose of the coronaviru vaccine, he told reporters: "I've been clear that President Trump should not be in office. Period."

Trump has been largely silent in recent days - making few statements and holding no news conferences. He has been banned from Twitter, his favoured public platform, for language that could incite violence.

He plans to travel Tuesday to Texas in one of his final trips as president, reportedly to claim success in delivering on his pledge to build a border wall to keep out immigrants from Mexico.

As Democrats began to act, the Capitol building was open to lawmakers and staff but under tight security and ringed by a metal fence after Wednesday's assault by Trump supporters that left five people dead.

HISTORIC SECOND IMPEACHMENT

Inside, some windows and doors that were broken and breached by rioters remained boarded up, while reinforced glass on doors near the Rotunda bore cracks from repeated battering.

The attack on Congress shook the core of American democracy and drew international condemnation. It has ignited a new effort to remove Trump, who is accused of whipping up the mob into storming the chambers where lawmakers were certifying Biden's Nov 3 win.

Speaking in the building's exalted Rotunda, House Democrat Katherine Clark said she felt "profoundly angry" about the invasion but expressed confidence the impeachment would be carried out.

"Every single day that this president is in office is a day of crisis for this country," Clark, a member of House leadership, told AFP.

"He has incited a seditious mob to come and overthrow our government and he needs to be held accountable for that and removed from office."

Trump was already impeached once by the Democratic-controlled House in December 2019 for pressuring Ukraine's president to dig up political dirt on Biden.

He was acquitted by the Republican-majority Senate.

If the House again votes to impeach, Trump would be the first US leader to be charged a second time with "high crimes and misdemeanours".

'ATTEMPTED COUP'

Even with time running short, House Democrats likely have the votes to impeach Trump again and congressman David Cicilline, who introduced the resolution, told reporters afterward he expects it will find Republican backing.

"This was an attempted coup to overthrow the government, and we have a responsibility as Congress to respond to that," said Cicilline.

Although two Republican Senators - Pat Toomey and Lisa Murkowski - have publicly called on Trump to resign, Democrats are unlikely to muster the two-thirds majority needed to convict Trump in the 100-member Senate and remove him from office.

The impeachment effort is nevertheless seen by Democrats as worthwhile.

While any conviction would likely occur after the president has left office, it would disqualify Trump, who is considering a run in 2024, from holding public office again.

Authorities are seeking to arrest more people who stormed the Capitol following a rally by the president repeating false claims that Democrats stole the election through fraud.

Trump was joined by Republic congressman Mo Brooks, who is facing censure in Congress after telling the crowd it was time to "start taking down names and kicking ass."

Despite the crackdown, Trump supporters have threatened new action in coming days both in Washington and state capitol buildings.

Senate rules mean the upper chamber would likely be unable to open an impeachment trial before Jan 19.

Some Democrats, for their part, have expressed concern that a Senate trial would hamper Biden's efforts to get his cabinet confirmed and quickly lay out his agenda, starting with the fight against the coronavirus and the need to support the economy.

Malaysia to reimpose MCO in some states: What do the Covid-19 restrictions entail - The Straits Times

KUALA LUMPUR - Malaysia on Monday (Jan 11) announced fresh nationwide movement restrictions to curb the increasing number of Covid-19 cases.

Five states - Melaka, Johor, Penang, Selangor and Sabah - and the federal territories of Kuala Lumpur, Labuan and Putrajaya will re-enter the movement control order (MCO), Prime Minister Muhyiddin Yassin announced in a televised address.

The reimposed measures will run from Wednesday to Jan 26.

Here are the key restrictions under the MCO:

•No travelling between states or districts

•Roadblocks will be set up to limit travel to a 10km radius from home

•People are urged to stay home. Only two people per household are allowed to head out to buy groceries

•Only two people are allowed per vehicle

•Social gatherings are banned, including weddings, seminars and group sport

•Eateries and hawker stalls may operate but only takeaways and food deliveries are allowed

•Supermarkets, healthcare services and banks are allowed to operate, with strict SOP compliance: always wear masks, use hand sanitiser frequently, and observe physical distancing at all times

•Outdoor recreational activities allowed among people from the same household

•No more than two people are allowed to jog together at any one time

•Only five essential economic sectors are allowed to operate: manufacturing, construction, service, trade and distribution, and plantations and commodities

•Non-essential services staff to work from home

•Maximum of five people allowed in mosques and houses of worship
