EU tariffs on China not a 'punishment', says German economy minister - CNA

Meeting Zheng Shanjie, chairman of China's National Development and Reform Commission, Habeck said the proposed EU tariffs were intended to level the playing field with China.

Zheng responded: "We will do everything to protect Chinese companies."

Proposed EU import duties on Chinese-made EVs would hurt both sides, Zheng added. He told Habeck he hoped Germany would demonstrate leadership within the EU and "do the correct thing".

He also denied the accusations of unfair subsidies, saying the development of China's new energy industry was the result of comprehensive advantages in technology, market and industry chains, fostered in fierce competition.

The industry growth "is the result of competition, rather than subsidies, let alone unfair competition", Zheng said during the meeting.

The EU provisional duties are set to apply by Jul 4, with the investigation set to continue until Nov 2, when definitive duties, typically for five years, could be imposed.

Habeck told Chinese officials the conclusions of the EU report should be discussed.

"It's important now to take the opportunity that the report provides seriously and to talk or negotiate," Habeck said.

After his meeting with Zheng, Habeck spoke with Chinese Commerce Minister Wang Wentao, who said he would discuss the tariffs with EU Commissioner Valdis Dombrovskis on Saturday evening via videoconference.

BN eyes Nenggiri state seat after Kelantan Speaker declares vacancy - Malay Mail

KUALA LUMPUR, June 21 — Datuk Seri Ahmad Zahid Hamidi today said the Barisan Nasional (BN) coalition might run for the vacant Nenggiri state constituency in Kelantan.

He said that even if BN is considered the underdog in the PAS-led east coast state, the coalition is ready for the expected by-election that has yet to be called, Bernama reported this afternoon.

“In the last Kelantan state election, BN candidate Ab Aziz Yusoff faced off against PAS candidate Mohd Azizi Abu Naim from Bersatu, resulting in Mohd Azizi's victory with an 810-vote majority,” he told reporters in Putrajaya earlier today, after a meeting with participants and organisers of the Mid Season Cup MLBB 2024.

“Considering our narrow loss of just under 800 votes, if a by-election is called, we understand that we would be the underdog. Nevertheless, we respect that this matter has been brought to court,” he was quoted as saying.

Zahid was also asked if the BN would field the rogue Bersatu assemblyman Mohd Azizi who was expelled from the party after the latter switched to support Prime Minister Datuk Seri Anwar Ibrahim.

“It’s open for discussion, and I believe our stance is that in any constituency with a by-election, priority will be given to candidates from the coalition parties within the Madani government,” Zahid, who is BN chairman and one of two deputies to Anwar, told reporters.

Kelantan State Legislative Assembly Speaker Datuk Mohd Amar Nik Abdullah declared Nenggiri to be vacant on June 19.

But several local news outlets reported Mohd Azizi plans to challenge the vacancy decision and has appointed a lawyer.

The Election Commission is scheduled to meet on June 28 to discuss holding a by-election in Nenggiri.

Illegal poaching threatens to wipe out South Sudan's elephants and other wildlife - CNA

The Uganda Wildlife Authority said it is aware of organised criminal networks involved in illegal wildlife trafficking from the nation to Vietnam, including one called the Viet Group.

Founded in northern Vietnam in the late 2000s, it allegedly started its operations in Africa with a view to sourcing wildlife and increasing its control of the illicit wildlife supply chain.

Once ivory from South Sudan is transported into Uganda, members of the group can gain access to it.

Vietnamese authorities said these members work with local suppliers in Mozambique and Uganda to get their hands on the illicit goods.

In 2019, Ugandan authorities arrested several Vietnamese nationals with ivory concealed in trucks that transport goods for export.

WILDLIFE CRIMES AFFECT TOURISM

The EIA, which investigates environmental crimes, said authorities need to do more than just seizing contraband to tackle wildlife poaching and trafficking.

“There has got to be follow-up investigation in the country where the goods are supposed to be sold, and where the goods came from,” said Mr Justin Gosling, a law enforcement and criminal justice consultant.

East Africa’s wildlife helps draw more than 5 million tourists every year to Uganda, Kenya, and Tanzania, providing jobs and contributing significantly to their gross domestic product.

Experts said South Sudan, with its pristine nature, stunning landscapes and rich biodiversity, has great potential for wildlife tourism too.

This can help boost the nation’s economy and its population, of which the United Nations estimate 80 per cent live below the absolute poverty line.

However, that would depend on the nation's efforts to protect its wildlife and stamp out poaching, as fears of extinction for many species – including its elephants – hang in the balance.

ByteDance alleges US’s ‘singling out of TikTok’ is unconstitutional - The Guardian

New legal filings from the Chinese tech firm ByteDance have challenged the US government’s “unconstitutional singling out of TikTok”, revealing fresh details about failed negotiations over a potential ban of the platform.

Legislation signed in April by Joe Biden gives ByteDance until 19 January to either divest TikTok’s US assets or face a ban. ByteDance claims in its new filings that such divestiture is “not possible technologically, commercially, or legally” and accuses the US government of refusing to engage in any serious settlement talks after 2022.

“Never before has Congress silenced so much speech in a single act,” the brief filed by TikTok said.

The proposed ban is the culmination of years of national security concerns among US lawmakers, who fear China could access data on Americans or spy on them through the app. The Biden administration has said it wants to see ByteDance sell off TikTok, rather than ban the app outright in the US – which the company claims is not feasible.

The proposed legislation will prohibit app stores, such as those run by Apple and Google, from offering the app unless ByteDance sells it. It also bars internet hosting services from supporting TikTok in the case it is not divested. Taken together, such measures would effectively prohibit use of the app within the US.

In the filings, lawyers for ByteDance recounted lengthy negotiations between the company and the US government, which they say abruptly ended in August 2022. The company also made public a redacted version of a 100-plus page draft national security agreement to protect the data of TikTok users in the US, and says it has spent more than $2bn on the effort.

The draft agreement included giving the US government a “kill switch” to suspend TikTok in the country at the government’s sole discretion if the company did not comply with the agreement, and says the US demanded that TikTok’s source code be moved out of China.

“This administration has determined that it prefers to try to shut down TikTok in the United States and eliminate a platform of speech for 170 million Americans, rather than continue to work on a practical, feasible, and effective solution to protect US users through an enforceable agreement with the US government,” TikTok lawyers wrote to the US justice department in a 1 April email made public on Thursday.

The justice department declined to comment on the email but said last month the law “addresses critical national security concerns in a manner that is consistent with the First Amendment and other constitutional limitations”. It said it would defend the legislation in court.

The US court of appeals for the District of Columbia will hold oral arguments on lawsuits filed by TikTok and ByteDance along with TikTok users on 16 September. TikTok’s future in the US may rest on the outcome of the case, which could impact how the government uses its new authority to clamp down on foreign-owned apps.

TikTok says any divestiture or separation – even if technically possible – would take years and it argues that the law runs afoul of Americans’ free speech rights. Further, it says the law unfairly singles out TikTok for punitive treatment and “ignores many applications with substantial operations in China that collect large amounts of US user data, as well as the many US companies that develop software and employ engineers in China”.

“This law is a radical departure from this country’s tradition of championing an open Internet, and sets a dangerous precedent allowing the political branches to target a disfavored speech platform and force it to sell or be shut down,” ByteDance and TikTok argue in the filings, which also included statements from lawyers for a group of eight creators on the platform.

The TikTok content creators say the law would violate their free speech rights. They also stated it is clear there are no imminent national security risks because the law “allows TikTok to continue operating through the rest of this year – including during an election that the very president who signed the bill says is existential for our democracy”.
