Theresa May’s Brexit Deal Is Rejected by U.K. Parliament - The New York Times

• With Britain in political crisis and a new deadline to leave the European Union two weeks away, Parliament on Friday rejected, by a vote of 334 to 286, Prime Minister Theresa May’s Brexit plan for a third time.

• Lawmakers voted down the 585-page withdrawal agreement, which details Britain’s relationship to the European Union through the end of 2020.

• The vote means that Britain is moving closer to a withdrawal on April 12 without an agreement — the “no-deal” scenario that many economists and officials have warned would do serious economic damage. The only alternative may be a long delay, a move opposed by pro-Brexit lawmakers.

• In a bid to win over hard-line Brexit supporters, Mrs. May promised Conservative lawmakers this week that she would step down as prime minister if the deal were approved. She had hoped that enough lawmakers would reverse course, despite their concerns, rather than risk crashing out without a deal.

British lawmakers on Friday rejected Prime Minister Theresa May’s plan for withdrawing from the European Union for the third time, leaving her policy in ruins and casting the nation’s politics into further confusion with the scheduled departure date looming two weeks away.

The vote on Friday might have been Mrs. May’s last chance to succeed on the issue that has dominated and defined her time in office, and the result left open an array of possibilities, including renewed demands for her resignation, early parliamentary elections and a second referendum.

The defeat, while narrower than in the previous two votes, appears to leave the increasingly weakened prime minister with two unpalatable options in the short run:

Britain can leave the bloc on April 12 without an agreement in place, a chaotic and potentially economically damaging withdrawal that threatens to leave the country with a shortage of food and medicine; or Mrs. May can ask European leaders — who have ruled out a short delay if her plan failed — for what would almost certainly be a long postponement.

“The implications of the house’s decision are grave,” she said after the vote, warning that it was not guaranteed that the bloc would give Britain more time.

The European Commission posted on Twitter, “ ‘No-deal’ scenario on 12 April is now a likely scenario.”

Hoping to win over Brexit hard-liners in her Conservative Party, Mrs. May promised lawmakers this week that she would step down if her plan were approved, giving the party a chance to choose a leader more to their liking to oversee the next round of negotiations. That got her some votes, but not enough.

Mrs. May has seen party discipline and her own authority shredded by successive parliamentary defeats, cabinet resignations and party defections over Brexit, and the vote on Friday left her even more battered — but apparently still in office.

In January, Parliament rejected her plan, 432 to 202 — a historic margin of defeat for a prime minister’s bill. A second vote on March 12 was another defeat, 391 to 242.

“If you want to deliver Brexit, this is the moment,” Mrs. May told Parliament before the vote.

But Parliament rebuffed her once again.

The future of the Irish border has been a contentious issue during Britain’s Brexit negotiations. We went to Northern Ireland, where residents worry that the free flow of goods and people could end once the United Kingdom leaves the European Union.

Parliament has twice rejected Mrs. May’s proposal, but this time there was a twist: Lawmakers were only voting on the withdrawal agreement, the legally binding part of the deal.

They set aside a decision on the nonbinding “political declaration,” a statement of what both sides want in Britain’s long-term relationship with the European Union. The two parts were separated to get around a procedural rule that had complicated Mrs. May’s efforts at a third attempt to get the deal through.

Mrs. May told Parliament that if lawmakers approved the withdrawal agreement, they would still have an opportunity to vote for a larger bill that would include the agreement — an assessment some Labour members disputed.

The withdrawal agreement sets the terms of a transition period after Britain leaves the bloc, while long-term arrangements are negotiated. It would last through the end of 2020, but could be extended for two years.

It lays out in detail the nation’s trade relationship with the bloc, keeping Britain tied, at least temporarily, to many European Union tariff, product and immigration rules, protecting trade ties and the rights of the bloc’s citizens who are already living in Britain.

This agreement also includes language dealing with the border between Ireland, a European Union member country, and Northern Ireland, a part of the United Kingdom — a confounding and divisive issue that has proved to be the biggest sticking point in Parliament.

At the moment, goods and people flow freely between Ireland and Northern Ireland. Under the withdrawal agreement, that arrangement would continue even if the two sides have not reached a long-term pact by the end of 2020, under a provision known as the backstop.

The backstop would keep Britain, and particularly Northern Ireland, tied to many European Union rules, to avoid building physical barriers on the border. That is anathema to many Brexit supporters, who fear that it could leave Britain permanently beholden to the bloc.

There was little expectation that Mrs. May’s plan would be approved, but in the hours before the vote a steady stream of lawmakers did promise to switch their votes and support her.

Dominic Raab, a former Brexit secretary and one of the most hard-line Conservative supporters of withdrawal, said on Friday that he would drop his opposition.

He was switching, he said, because there was “a significant risk of losing Brexit altogether,” referring to concerns that Britain might be forced to seek a longer extension, which would give opponents of Brexit more time to muster support to fight withdrawal.

Writing on Twitter, Boris Johnson, a former foreign secretary who has been an vocal critic of Mrs. May’s proposal, said that he would support it, although it was “very painful to vote for this deal.”

Iain Duncan Smith, a staunch Brexit supporter and a former leader of the Conservative Party, said that he would vote for the deal. Ross Thomson, who voted against it twice, also said that he would change his vote.

But Mrs. May’s prospects were largely dependent on how many opposition lawmakers she could win over, and she fell far short of that threshold.

“Shame on you! Shame on you! Shame on you!”

With those words, pro-Brexit activists congregated outside Parliament on Friday morning, heaping anger on lawmakers who they said were thwarting the results of the 2016 referendum.

The crowd in the morning was sparse but grew as the day went on, with people drinking tea from thermoses, waving Union Jack flags and holding placards denouncing, among other things, “anti-British globalists.”

The protesters, most of them men, cut a striking contrast with the hundreds of thousands who turned out for an anti-Brexit march in London last weekend.

“We should be leaving now,” Paul Ellis, the legal officer of the For Britain Movement, said as he was walking toward Parliament Square. “As of today, Parliament no longer has the permission of the people to surrender power to the European Union.”

If Parliament votes to delay or stop Brexit, he said before Parliament acted on Friday, “It means that Britain is no longer a democracy.”

After arriving at Parliament Square, he unfurled his group’s banner in front of a statue of Winston Churchill.

What is a blindfold Brexit?

That is the name the opposition Labour Party has given to Mrs. May’s ploy of splitting her deal in two: a withdrawal agreement that gets Britain out of the European Union’s door, and a political declaration that says where it is supposed to go from there.

For tactical reasons, the Conservative government wanted Parliament to vote on them separately. But Labour leaders said that asking lawmakers to vote on the first, without the road map provided by the second, was like putting a blindfold on Parliament.

Making matters worse for Labour, Mrs. May promised to resign if her deal passed, leaving future negotiations in a new Conservative leader’s hands. That could very well be a hard-line Brexiteer, and Labour fears that such a leader would cut trading ties with Europe at the risk of hurting Britain’s economy.

“It could be a Boris Johnson Brexit, a Jacob Rees-Mogg Brexit, or a Michael Gove Brexit,” said Keir Starmer, a senior Labour lawmaker, referring to various pro-Brexit Conservatives.

Jeremy Corbyn, the Labour leader, compared that to playing “roulette with this country’s future.”

Some Labour members proposed an amendment to Mrs. May’s deal that would have given Parliament some say in shaping the political declaration — a way of taking off the figurative blindfold. But the speaker of the House of Commons did not select the amendment for a vote.

Some British news outlets reported on Friday that, in a desperate bid to win the backing of Labour members, the government was offering money to finance projects in their districts.

Like many moments in Britain’s prolonged journey, it’s not entirely clear.

Britain was originally set to leave the European Union on Friday, but European leaders agreed last week to a short extension.

Now that lawmakers have rejected it again, and if Britain takes no further action, it would withdraw on April 12 without an agreement — an option wanted by neither the European Union nor most British lawmakers.

Mrs. May could once again ask Brussels for more time. But European leaders have said that they would be open in such a case only to a long extension, possibly of a year or more, to allow for a fundamental rethinking of Britain’s position.

“The European Union have been clear that any further extension will need to have a clear purpose,” she said after the vote, and would require agreement by the heads of government of Britain and the other 27 member nations.

Minutes after Parliament defeated the plan, Donald Tusk, president of the European Council, one of the European Union’s governing bodies, announced that, in light of the vote, he was calling a council meeting on April 10.

A long postponement would require Britain to elect representatives to the European Parliament in voting that would take place from May 23 to 26 in all member states. If Britain chose not to take part, it would leave with no deal at 11 p.m. London time on April 12.

Both Labour and Scottish National Party leaders said that Mrs. May should call an early general election. The deadlock in London could force Mrs. May to go that route, and it could also build support for a second referendum.

In addition, Ian Blackford, the leader of the Scottish National Party, said, “We must now look seriously at the option of revocation” of Article 50, the provision of the Lisbon Treaty that Britain invoked to leave the European Union.

With Mrs. May’s promise to step down, approval of the agreement would have set off a fight among Conservatives to choose a new leader.

Many people in Britain and on the Continent are getting tired of the uncertainty. Among them is Jon Worth, a political consultant who has been making (and remaking) flowcharts to map the potential outcomes of the withdrawal process.

Mr. Worth, who works as a communications consultant for European politicians, has made 27 versions of his Brexit flowcharts, mapping every twist and turn in the political saga.

For Brexit supporters, March 29 — the originally scheduled day of Britain’s official departure from the European Union — was supposed to be one big party, with a gala celebration at 11 p.m.

Big Ben, currently silenced by a renovation of the famous London clock tower, was to emerge from the scaffolding to chime Britain out of the European Union, sounding the death knell for 45 years of European integration. A commemorative coin was planned by the Royal Mint.

Either March 29 or June 23, the date of the 2016 referendum to leave the bloc, was supposed to be established as “Independence Day.” But the champagne is still on ice.

“I dearly wish we could be toasting Britain’s freedom with champagne at 11 p.m. on Friday, just as we’d planned,” said Allison Pearson, a columnist for the stridently pro-Brexit Daily Telegraph. “Under the circumstances, half a glass of Tizer and Nurofen is more like it,” she said, referring to a British soft drink and a painkiller.

Asked this month about the fate of the March 29 commemorative coins, the chancellor of the Exchequer, Philip Hammond, said he was unsure whether they had actually been made. If so, he told the BBC, “they will become collectors’ pieces.”

“I have heard very clearly the mood of the parliamentary party,” Mrs. May told Conservative lawmakers gathered in a meeting room in Parliament this week, as she announced plans to step aside if her Brexit plan were approved. “I know there is a desire for a new approach, and new leadership, in the second phase of the Brexit negotiations, and I won’t stand in the way of that.”

After the surprise offer on Wednesday, political analysts were quick to speculate about who might replace her. Her departure, which would not come before the May 22 withdrawal date, would leave the Conservative Party to select a new leader to see the process through.

Candidates for party leadership have to be nominated by two other members of Parliament, though if there is only one candidate, he or she automatically becomes the new leader. If more than two candidates emerge, lawmakers vote among themselves to narrow the field and then put two candidates to a vote by all party members, not just those in Parliament.

There is no obvious front-runner, but British bookmakers are already offering odds on some of the politicians they believe to be probable contenders for the job. They include hard-line Brexit supporters, vocal critics of the prime minister’s approach and supporters of her strategy.

The House of Commons voted 334 to 286 against the Brexit deal, triggering the possibility of the so-called "no deal" divorce between the United Kingdom and the EU. Now lawmakers have until April 12 to announce a new plan or leave the EU without a deal - a massive risk for disruption for people and businesses.

May said the implications of the lawmaker's rejection to the deal are "grave" and that it should be a "matter of profound regret" that "once again we have been unable to support leaving the European Union in an orderly fashion."

Immediately following the latest defeat, Opposition leader Jeremy Corbyn called on May to resign immediately, asking whether she now "finally accepts" that MPs will not support her deal.

The Sterling fell through the $1.30 mark against the U.S. dollar, for the first time since March 11th, as the result of the vote was announced..

Parliament voted on the 585-page withdrawal agreement that sets out the terms of Britain’s departure – including its financial settlement with the EU and the rights of EU and U.K. citizens – but not a shorter declaration on future tires that is also part of the divorce deal agreed between the U.K. and the European bloc late last year.

Its removal altered the deal enough to overcome a ban against asking lawmakers the same question over and over again.

May’s deal, agreed with the European bloc in November, was previously rejected by 230 votes on Jan. 15 and by 149 votes on March 12. Ahead of Friday’s vote, May needed at least 75 lawmakers to change over, while losing none.

The EU reacted to Friday’s defeat saying it “regrets the negative vote” and that it is now fully prepared to a “no-deal” scenario on April 12.

“The EU will remain united,” a spokesperson said.

Donald Tusk, the European council president, called an emergency EU summit for April 10 in light of the vote. That is two days before the deadline for the U.K.’s departure.

Solicitor General Robert Buckland told the BBC that "we are now in completely uncharted waters".

"The prospect of no Brexit is now becoming very real indeed," he said.

BREXIT OR NO BREXIT, THE US-BRITISH ALLIANCE REMAINS VITAL

Outside the House of Parliament, pro-Brexit protesters brought traffic to a halt by blocking roads, local media reported. They chanted “We shall not be moved” and “Leave means leave.”

The EU had confirmed Friday that a U.K. Parliament vote to pass the withdrawal agreement alone would be "necessary and sufficient" to secure Britain's orderly departure on May 22.

Ahead of Friday, May needed the support of the Democratic Unionist Party in Northern Ireland, which has refused to back the agreement because it treats Northern Ireland differently from the rest of the U.K. The small party has 10 seats in the House of Commons and some Brexit backers say they will take their cue from the DUP.

TRUMP BACKS BREXIT BY PROMISING A 'LARGE SCALE TRADE DEAL' WITH UK

In a last-ditch effort to sway remaining naysayers, May pledged Wednesday to quit if lawmakers approved the deal and let Britain leave the EU in May.

"I have heard very clearly the mood of the parliamentary party," she said at the time. "I know there is a desire for a new approach – and new leadership – in the second phase of the Brexit negotiations – and I won’t stand in the way of that."

Earlier Friday, Attorney General Geoffrey Cox urged divided legislators to support the deal and finally break an impasse that has left Britons uncertain when, or even if, the country will leave the EU.

Cox said Parliament should take "a single decisive step ... to afford certainty to the millions of people who are waiting for it."

Some previously resistant Brexit-backers have moved to support the deal. Former Foreign Secretary Boris Johnson — a likely contender to replace May as Conservative Party leader — tweeted that rejecting it risked "being forced to accept an even worse version of Brexit or losing Brexit altogether."

Two years ago, Britain triggered a two-year countdown to Brexit, with the departure date set for March 29, 2019. Lawmakers were granted an extension by the EU last week amid their impasse.

The uncertainty around Brexit, the United Kingdom’s most significant political and economic move since World War Two, has left allies and investors aghast.

The EU had indicated it could grant Britain a longer delay to Brexit if it plans to change course and tack toward a softer departure. That would, however, require the U.K. to participate in elections for the European Parliament in late May.

Before the vote, a group of breakaway Tory and Labour MPs applied to become an official political party called “Change UK” – just in time for the European elections. They have named former Conservative MP Heidi Allen as interim leader.

The petitions site Change.org said Friday it's seeking urgent legal advice to prevent the group using similar branding.

"This new party is using the language of Change.org. Our movement is one of 17 million people across the UK and we can’t allow ourselves to be hijacked in this way,” a company source said.

Brexit live updates: Parliament again rejects Theresa May's Brexit deal on day Britain was supposed to 'take back control' - The Washington Post

LONDON — Prime Minister Theresa May’s Brexit deal was beaten down for an amazing, unprecedented, pitiful third time by the British Parliament on Friday, with all bets off now on when or how the United Kingdom will leave the European Union.

The E.U. had given Britain until the end of this week to approve the withdrawal agreement. Now it has until April 12 to propose a new way forward, or crash out of the bloc without a deal.

May called the results “grave.”

The leader of the Labour Party opposition, Jeremy Corbyn, called for a general election.

Within minutes of the vote, European leaders on the other side of the English channel agreed to convene in Brussels on April 10 for crisis discussions.

Speaking after the vote, May said “once again, we have been unable to support leaving the European Union in an orderly fashion.”

May said, “I fear we are reaching the limits of this process in this House. This House has rejected no deal, it has rejected no Brexit, on Wednesday it rejected all the variations of the deal on the table and today it has rejected approving the withdrawal agreement alone.”

The prime minister’s stripped-down version of her twice-defeated Brexit deal lost by 58 votes — 344 to 286 — in yet another “last ditch” and “cliff edge” attempt to exit from the European Union.

The third losing vote for May in the House of Commons came on the day Britain was due to “take back control” and depart the continental trading bloc.

May’s orderly Brexit is now in tatters. It is possible that Britain will leave with no deal, or will seek a long extension.

Instead of Brexiteers gulping pints and waving Union Jack flags to celebrate what they were, once upon a time, calling “British Independence Day,” (copyright pending re: American Revolution) the parliamentarians are still debating how and whether they want to leave.

“Today should have been the day that the United Kingdom left the European Union. That we are not leaving today is a matter of deep personal regret to me,” May said, moments before lawmakers started voting.

“There are those who will say, ‘the House has rejected every option so far, you’ll probably lose, so why bother?’ I bother because this is the last opportunity to guarantee Brexit,” she said.

The prime minister offered to resign if her own Conservative Party could help deal over the line. And that did help convince some members to back it — but not enough.

In a series of tweets on Friday morning, Boris Johnson, Britain’s former foreign secretary and a favorite to replace May, explained his screeching U-turn. 

Recall: Johnson once described May’s deal as something akin to donning a “suicide vest,” but on Friday said that not voting for it posed the “risk of being forced to accept an even worse version of Brexit or losing Brexit altogether.”

Dominic Raab, the former Brexit secretary and another potential contender for May’s job, said he was now on board.

“I will vote for the motion,” he said, prompting cheers and jeers in the Commons on Friday. 

Backing it will “stave off a longer extension and prevent European elections in May,” Raab said

But May needed more than just Conservative Party “switchers.” She needed the Democratic Unionist Party, who voted against the government. 

She also needed a handful of Labour lawmakers. 

On Friday, Labour leader Jeremy Corbyn told Parliament the deal was “bad for our democracy, bad for our economy and bad for this country” and he urged lawmakers “not to not to be cajoled for this third-time-lucky strategy and vote it down today.”

The House of Commons voted only on part of the Brexit treaty — the 585-page withdrawal agreement. That’s the part of the treaty that spells out, in a legally binding way, how much Britain will pay to leave the European Union ($50 billion), how the two-year transition will preserve the status quo for trade and travel (no change), and how Britain and the European Union will treat each other’s citizens in the interim (nobody gets kicked out of anybody’s country).

The withdrawal agreement also includes the controversial “Irish backstop,” an ironclad guarantee to preserve the open, invisible border between Northern Ireland and the Republic of Ireland — with trade-offs that have been a stopping point in the past.

Parliament did not vote Friday on the second part of the treaty, the political declaration, which sets out the aspirations for the future relationship on trade, security and borders.

When European leaders meet next month, they hope to hear a clear plan from May about a fresh approach to Brexit, along with a willingness to hold elections for European Parliament to buy Britain some time. If not, they will brace themselves for a disorderly British departure just two days after they meet.

The defeat sparked immediate concern across Europe. “Very discouraging. UK must now show a way to avoid a #NoDeal,” wrote Danish Prime Minister Lars Lokke Rasmussen on Twitter. “Almost out of options and time. We will intensify our no deal preparations.”

European diplomats watched the British proceedings with increasing alarm – yes, apparently it was still possible for them to get more worried — and were hashing out the day-after scenarios for a disorderly Brexit.

German Chancellor Angela Merkel, who fears that Ireland has not done enough to get ready to defend its border with Northern Ireland against smuggling, plans to visit Dublin next week to press leaders there.

E.U. ambassadors, meanwhile, gathered Thursday to sort out their conditions for talks with Britain if it crashes out without a divorce deal.

Britain would have to commit to paying its E.U. bills of at least $51 billion. It would need to find a way to keep the Irish border open – potentially by keeping Northern Ireland within the E.U. customs zone, exactly what Brexiteers loathe. And it would have to extend rights to E.U. citizens living in Britain, according to a diplomat familiar with the talks who spoke on condition of anonymity to disclose confidential discussions.

If British lawmakers decide they want a closer relationship with the European Union than they have already negotiated, E.U. diplomats say there is flexibility and willingness to keep talking. But Britain would have to organize European elections in May so that it remains an E.U. member in good standing.

In Brussels, the top British E.U. official, European Commissioner Julian King, was spotted walking through a park “somewhat aimless and forlornly,” according to Sam Morgan, the journalist with the Euractiv publication who spotted him.

“Short break!” King replied on Twitter, and said he was otherwise busy working as normal.

On social media, the search term trending was “Kafka Brexit,” in a nod to the never-ending bureaucratic nightmares of Franz Kafka’s fictional world.

When a BBC reporter asked a cabinet minister why the prime minister would hold the vote when she almost certainly faces defeat, he was told: “F--- knows. I am past caring. It is like the living dead in here.”

On Friday, the newly-formed group of lawmakers known as the Independent Group applied to form a new political party called ChangeUK, which hopes to field candidates in the European elections if Britain takes part in them. The group is formed of 11 politicians who broke away from the Conservative and Labour Party over their handling of Brexit.

Parliament voted on the 585-page withdrawal agreement that sets out the terms of Britain’s departure – including its financial settlement with the EU and the rights of EU and U.K. citizens – but not a shorter declaration on future tires that is also part of the divorce deal agreed between the U.K. and the European bloc late last year.

Its removal altered the deal enough to overcome a ban against asking lawmakers the same question over and over again.

May’s deal, agreed with the European bloc in November, was previously rejected by 230 votes on Jan. 15 and by 149 votes on March 12. Ahead of Friday’s vote, May needed at least 75 lawmakers to change over, while losing none.

The EU reacted to Friday’s defeat saying it “regrets the negative vote” and that it is now fully prepared to a “no-deal” scenario on April 12.

“The EU will remain united,” a spokesperson said.

Donald Tusk, the European council president, called an emergency EU summit for April 10 in light of the vote. That is two days before the deadline for the U.K.’s departure.

Solicitor General Robert Buckland told the BBC that "we are now in completely uncharted waters".

"The prospect of no Brexit is now becoming very real indeed," he said.

Outside the House of Parliament, pro-Brexit protesters brought traffic to a halt by blocking roads, local media reported. They chanted “We shall not be moved” and “Leave means leave.”

The EU had confirmed Friday that a U.K. Parliament vote to pass the withdrawal agreement alone would be "necessary and sufficient" to secure Britain's orderly departure on May 22.

Ahead of Friday, May needed the support of the Democratic Unionist Party in Northern Ireland, which has refused to back the agreement because it treats Northern Ireland differently from the rest of the U.K. The small party has 10 seats in the House of Commons and some Brexit backers say they will take their cue from the DUP.

In a last-ditch effort to sway remaining naysayers, May pledged Wednesday to quit if lawmakers approved the deal and let Britain leave the EU in May.

"I have heard very clearly the mood of the parliamentary party," she said at the time. "I know there is a desire for a new approach – and new leadership – in the second phase of the Brexit negotiations – and I won’t stand in the way of that."

It is unclear if May will immediately resign as prime minister.

Earlier Friday, Attorney General Geoffrey Cox urged divided legislators to support the deal and finally break an impasse that has left Britons uncertain when, or even if, the country will leave the EU.

Cox said Parliament should take "a single decisive step ... to afford certainty to the millions of people who are waiting for it."

Some previously resistant Brexit-backers have moved to support the deal. Former Foreign Secretary Boris Johnson — a likely contender to replace May as Conservative Party leader — tweeted that rejecting it risked "being forced to accept an even worse version of Brexit or losing Brexit altogether."

Two years ago, Britain triggered a two-year countdown to Brexit, with the departure date set for March 29, 2019. Lawmakers were granted an extension by the EU last week amid their impasse.

The uncertainty around Brexit, the United Kingdom’s most significant political and economic move since World War Two, has left allies and investors aghast.

The EU had indicated it could grant Britain a longer delay to Brexit if it plans to change course and tack toward a softer departure. That would, however, require the U.K. to participate in elections for the European Parliament in late May.

Before the vote, a group of breakaway Tory and Labour MPs applied to become an official political party called “Change UK” – just in time for the European elections. They have named former Conservative MP Heidi Allen as interim leader.

The petitions site Change.org said Friday it's seeking urgent legal advice to prevent the group using similar branding.

This new party is using the language of Change.org. Our movement is one of 17 million people across the UK and we can’t allow ourselves to be hijacked in this way,” a company source said.

LONDON —  Theresa May’s Brexit deal was slapped down for third time by the British Parliament on Friday, with all bets off on when or how United Kingdom will leave the European Union.

The E.U. gave Britain until the end of this week to approve the withdrawal agreement. Now it has until April 12 to propose a new plan, or leave the bloc without a deal.

The prime minister’s stripped-down version of her twice-defeated Brexit deal lost on Friday by 58 votes — 344 to 286 — in yet another “last ditch” and “cliff edge” attempt to exit from the European Union.

The third losing vote for May in the House of Commons came on the day Britain was due to “take back control” and depart the continental trading bloc.

But instead of Brexiteers gulping pints and waving Union Jack flags to celebrate what they were, once upon a time, calling “British Independence Day,” (copyright pending re: American Revolution) the parliamentarians are still debating how and whether they want to leave.

“Today should have been the day that the United Kingdom left the European Union. That we are not leaving today is a matter of deep personal regret to me,” May said, moments before lawmakers started voting.

“There are those who will say, ‘the House has rejected every option so far, you’ll probably lose, so why bother?’ I bother because this is the last opportunity to guarantee Brexit,” she said.

The prime minister offered to resign if her own Conservative Party could help deal over the line. And that did help convince some members to back it — but not enough.

In a series of tweets on Friday morning, Boris Johnson, Britain’s former foreign secretary and a favorite to replace May, explained his screeching U-turn. 

Recall: Johnson once described May’s deal as something akin to donning a “suicide vest,” but on Friday said that not voting for it posed the “risk of being forced to accept an even worse version of Brexit or losing Brexit altogether.”

Dominic Raab, the former Brexit secretary and another potential contender for May’s job, said he was now on board.

“I will vote for the motion,” he said, prompting cheers and jeers in the Commons on Friday. 

Backing it will “stave off a longer extension and prevent European elections in May,” Raab said

But May needed more than just Conservative Party “switchers.” She needed the Democratic Unionist Party, who voted against the government. 

She also needed a handful of Labour lawmakers. 

On Friday, Labour leader Jeremy Corbyn told Parliament the deal was “bad for our democracy, bad for our economy and bad for this country” and he urged lawmakers “not to not to be cajoled for this third-time-lucky strategy and vote it down today.”

The House of Commons voted only on part of the Brexit treaty — the 585-page withdrawal agreement. That’s the part of the treaty that spells out, in a legally binding way, how much Britain will pay to leave the European Union ($50 billion), how the two-year transition will preserve the status quo for trade and travel (no change), and how Britain and the European Union will treat each other’s citizens in the interim (nobody gets kicked out of anybody’s country).

The withdrawal agreement also includes the controversial “Irish backstop,” an ironclad guarantee to preserve the open, invisible border between Northern Ireland and the Republic of Ireland — with trade-offs that have been a stopping point in the past.

Parliament did not vote Friday on the second part of the treaty, the political declaration, which sets out the aspirations for the future relationship on trade, security and borders.

The hope, from Team May, was that the withdrawal agreement on its own will win over more votes than the overall agreement. They were also trying to get around a ruling by House of Commons Speaker John Bercow that the government cannot repeatedly present the same motion for a vote.

On Friday, Brexit dominated the front pages of British newspapers and websites — but not in the way Brexiteers might have imagined exactly two years ago, Britain gave its formal notice to the E.U. that it would be leaving the bloc on March 29, 2019.

“Darkest Hour for Democracy,” ran the front-page headline in the Daily Express, one of the most pro-Brexit newspapers. “One Last Chance,” said the Daily Mail, urging parliamentarians to “put your country first” and back May’s deal. “The day of reckoning,” said the Daily Telegraph.

On social media, the search term trending was “Kafka Brexit,” in a nod to the twisted, nightmarish qualities of Franz Kafka’s fictional world.

When a BBC reporter asked a cabinet minister why the prime minister would hold the vote when she almost certainly faces defeat, he was told: “F--- knows. I am past caring. It is like the living dead in here.”

On Friday, the newly-formed group of lawmakers known as the Independent Group applied to form a new political party called ChangeUK, which hopes to field candidates in the European elections if Britain takes part in them. The group is formed of 11 politicians who broke away from the Conservative and Labour Party over their handling of Brexit.

The emerging Boeing 737 MAX scandal, explained - Vox.com

Boeing executives are offering a simple explanation for why the company’s best-selling plane in the world, the 737 MAX 8, crashed twice in the past several months, leaving Jakarta, Indonesia, in October and then Addis Ababa, Ethiopia, in March. Executives claimed Wednesday, March 27, that the cause was a software problem — and that a new software upgrade fixes it.

But this open-and-shut version of events conflicts with what diligent reporters in the aviation press have uncovered in the weeks since Asia, Europe, Canada, and then the United States grounded the planes.

The story begins nine years ago when Boeing was faced with a major threat to its bottom line, spurring the airline to rush a series of kludges through the certification process — with an under-resourced Federal Aviation Administration (FAA) seemingly all too eager to help an American company threatened by a foreign competitor, rather than to ask tough questions about the project.

The specifics of what happened in the regulatory system are still emerging (and despite executives’ assurances we don’t even really know what happened on the flights yet). But the big picture is coming into view: A major employer faced a major financial threat, and short-term politics and greed won out over the integrity of the regulatory system. It’s a scandal.

There are lots of different passenger airplanes on the market, but just two very similar narrow-body planes dominate domestic (or intra-European) travel. One is the European company Airbus’s 320 family, with models called A318, A319, A320, or A321 depending on how long the plane is. These four variants, by design, have identical flight decks so pilots can be trained to fly them interchangeably.

The 320 family competes with a group of planes that Boeing calls the 737 — there’s a 737-600, a 737-700, a 737-800, and a 737-900 — with higher numbers indicating larger planes. Some of them are also extended-range models that have an ER appended to the name and, as you would probably guess, they have longer ranges.

Importantly, even though there are many different flavors of 737, they are all in some sense the same plane, just as all the different 320 family planes are the same plane. Southwest Airlines, for example, simplifies its overall operations by exclusively flying different 737 variants.

Both the 737 and the 320 come in lots of different flavors, so airlines have plenty of options in terms of what kind of aircraft should fly exactly which route. But because there are only two players in this market, and because their offerings are so fundamentally similar, the competition for this slice of the plane market is both intense and weirdly limited. If one company were to gain a clear technical advantage over the other, it would be a minor catastrophe for the losing company.

And that’s what Boeing thought it was facing.

Jet fuel is a major cost for airlines. With labor costs largely driven by collective bargaining agreements and regulations that require minimum ratios of flight attendants per passenger, fuel is the cost center airlines have the most capacity to do something about. Consequently, improving fuel efficiency has emerged as one of the major bases of competition between airline manufacturers.

If you roll back to 2010, it began to look like Boeing had a real problem in this regard.

Airbus was coming out with an updated version of the A320 family that it called the A320neo, with “neo” meaning “new engine option.” The new engines were going to be a more fuel-efficient design, with a larger diameter than previous A320 engines, that could nonetheless be mounted on what was basically the same airframe. This was a nontrivial engineering undertaking both in designing the new engines and in figuring out how to make them work with the old airframe, but even though it cost a bunch of money, it basically worked. And it raised the question of whether Boeing would respond.

Initial word was that it wouldn’t. As CBS Moneywatch’s Brett Snyder wrote back in December 2010, the basic problem was that you couldn’t slap the new generation of more efficient, larger-diameter engines onto the 737:

One of the issues for Boeing is that it takes more work to put new engines on the 737 than on the A320. The 737 is lower to the ground than the A320, and the new engines have a larger diameter. So while both manufacturers would have to do work, the Boeing guys would have more work to do to jack the airplane up. That will cost more while reducing commonality with the current fleet. As we know from last week, reduced commonality means higher costs for the airlines as well.

Under the circumstances, Boeing’s best option was to just take the hit for a few years and accept that it was going to have to start selling 737s at a discount price while it took the time to design a whole new airplane. That would, of course, be time-consuming and expensive, and during the interim they’d probably lose a bunch of narrow-body sales to Airbus.

The original version of the 737 first flew in 1967, and a decades-old decision about how much height to leave between the wing and the runway left them boxed-out of 21st century engine technology — and there was simply nothing to be done about it.

Unless there was.

As late as February 2011, Boeing chair and CEO James McNerney was sticking to the plan to design a totally new aircraft.

“We’re not done evaluating this whole situation yet,” he said on an analyst call, “but our current bias is to move to a newer airplane, an all-new airplane, at the end of the decade, beginning of the next decade. It’s our judgment that our customers will wait for us.”

But then in August 2011, Boeing announced that it had lined up orders for 496 re-engined Boeing 737 aircraft from five different airlines.

It’s not entirely clear what happened, but, reading between the lines, it seems that in talking to its customers Boeing reached the conclusion that airlines would not wait for them. Some critical mass of carriers (American Airlines seems to have been particularly influential) was credible enough in its threat to switch to Airbus equipment that Boeing decided it needed to offer 737 buyers a Boeing solution sooner rather than later.

Committing to putting a new engine that didn’t fit on the plane was the corporate version of the Fyre Festival’s “let’s just do it and be legends, man” moment, and it not surprisingly wound up leading to a slew of engineering and regulatory problems.

As the industry trade publication Leeham News and Analysis explained earlier in March, Boeing engineers had been working on the concept that became their 737 MAX even back when the company’s plan was still not to build it.

In a March 2011 interview with Aircraft Technology, Mike Bair, then the head of 737 product development, said that reengineeing was possible.

“There’s been fairly extensive engineering work on it,” he said. “We figured out a way to get a big enough engine under the wing.”

The problem is that an airplane is a big, complicated network of interconnected parts. To get the engine under the 737 wing, engineers had to mount the landing gears higher and more forward on the plane. But moving the landing gears changed the aerodynamics of the plane, such that the plane did not handle properly at a high angle of attack. That, in turn, led to the creation of the Maneuvering Characteristics Augmentation System (MCAS). It fixed the angle-of-attack problem in most situations, but it created new problems in other situations when it made it difficult for pilots to directly control the plane without being overridden by the MCAS.

On Wednesday, Boeing rolled out a software patch that it says corrects the problem, and it hopes to persuade the FAA to agree.

But note that the underlying problem isn’t really software, it’s with the effort to use software to get around a whole host of other problems.

Recall, after all, that the whole point of the 737 MAX project was to be able to say that the new plane was the same as the old plane. From an engineering perspective, the preferred solution was to actually build a new plane. But for business reasons, Boeing didn’t want a “new plane” that would require a lengthy certification process and extensive (and expensive) new pilot training for its customers. The demand was for a plane that was simultaneously new and not new.

But because the new engines wouldn’t fit under the old wings, the new plane wound up having different aerodynamic properties than the old plane. And because the aerodynamics were different, the flight control systems were also different. But treating the whole thing as a fundamentally different plane would have undermined the whole point. So the FAA and Boeing agreed to sort of fudge it.

As far as we can tell, the 737 MAX is a perfectly airworthy plane in the sense that error-free piloting allows it to be operated safely.

But pilots of planes that didn’t crash kept noticing the same basic pattern of behavior that is suspected to have been behind the two crashes, according to a Dallas Morning News review of voluntary aircraft incident reports to a NASA database.

The disclosures found by the News reference problems with an autopilot system, and they all occurred during the ascent after takeoff. Many mentioned the plane suddenly nosing down. While records show these flights occurred in October and November, the airlines the pilots were flying for is redacted from the database.

These pilots all safely disabled the MCAS and kept their planes in the air. But one of the pilots reported to the database that it was “unconscionable that a manufacturer, the FAA, and the airlines would have pilots flying an airplane without adequately training, or even providing available resources and sufficient documentation to understand the highly complex systems that differentiate this aircraft from prior models.”

The training piece is important because a key selling feature of the 737 MAX was the idea that since it wasn’t really a new plane, pilots didn’t really need to be retrained for the new equipment. As the New York Times reported, “For many new airplane models, pilots train for hours on giant, multimillion-dollar machines, on-the-ground versions of cockpits that mimic the flying experience and teach them new features” while the experienced 737 MAX pilots were allowed light refresher courses that you could do on an iPad.

That let Boeing get the planes into customers’ hands quickly and cheaply, but evidently at the cost of increasing the possibility of pilots not really knowing how to handle the planes, with dire consequences for everyone involved.

In a blockbuster March 17 report for the Seattle Times, the newspaper’s aerospace reporter Dominic Gates details the extent to which the FAA delegated crucial evaluations of the 737’s safety to Boeing itself. The delegation, Gates explains, is in part a story of a years-long process during which the FAA “citing lack of funding and resources, has over the years delegated increasing authority to Boeing to take on more of the work of certifying the safety of its own airplanes.”

But there are indications of failures that were specific to the 737 MAX timeline. In particular, Gates reports that “as certification proceeded, managers prodded them to speed the process” and that “when time was too short for FAA technical staff to complete a review, sometimes managers either signed off on the documents themselves or delegated their review back to Boeing.”

Most of all, decisions about what could and could not be delegated were being made by managers concerned about the timeline, rather than by the agency’s technical experts.

It’s not entirely clear at this point why the FAA was so determined to get the 737 cleared quickly (there will be more investigations), but if you recall the political circumstances of this period in Barack Obama’s presidency, you can quickly get a general sense of the issue.

Boeing is not just a big company with a significant lobbying presence in Washington, it’s a major manufacturing company with a strong global export presence and a source of many good-paying union jobs. In short, it was exactly the kind of company that the powers that be were eager to promote — with the Obama White House, for example, proudly going to bat for the Export-Import Bank as a key way to sustain America’s aerospace industry.

A story about overweening regulators delaying an iconic American company’s product launch and costing us good jobs compared to the European competition would have looked very bad. And the fact that the whole purpose of the plane was to be more fuel-efficient only made getting it off the ground a bigger priority. But the incentives really were reasonably aligned, and Boeing has only caused problems for itself by cutting corners.

One emblem of the whole situation is that as the 737 MAX engineering team piled kludge on top of kludge, one thing they came up with was a cockpit warning light that would alert the pilots if the plane’s two angle-of-attack sensors disagreed.

But then, as Jon Ostrower reported for the Air Current, Boeing’s team decided to make the warning light an optional add-on, like how car companies will uncharge you for a moon roof.

The light cost $80,000 extra per plane and neither Lion Air nor Ethiopian chose to buy it, perhaps figuring that Boeing would not sell a plane (nor would the FAA allow it to) that was not basically safe to fly. In the wake of the crashes, Boeing has decided to revisit this decision and make the light standard on all aircraft.

Now to be clear, Boeing has lost about $40 billion in stock market valuation since the crash, so it’s not like cheating out on the warning light turned out to have been a brilliant business decision or anything.

This, fundamentally, is one reason the FAA has become comfortable working so closely with Boeing on safety regulations: The nature of the airline industry is such that there’s no real money to be made selling airplanes that have a poor safety track record. One could even imagine sketching out a utopian libertarian argument to the effect that there’s no real need for a government role in certifying new airplanes at all, precisely because there’s no reason to think it’s profitable to make unsafe ones.

The real world, of course, is quite a bit different from that, and different individuals and institutions face particular pressures that can lead them to take actions that don’t collectively make sense. Looking back, Boeing probably wishes it had just stuck with the “build a new plane” plan and stuck it out for a few years of rough sales, rather than ending up in the current situation. Right now they are, in effect, trying to patch things up piecemeal — a software update here, a new warning light there, etc. — in hopes of persuading global regulatory agencies to let their planes fly again.

But even once that’s done, they face the task of convincing airlines to actually go buy their planes. An informative David Ljunggren article for Reuters reminds us that a somewhat comparable situation arose in 1965 when three then-new Boeing 727 jetliners crashed.

There wasn’t really anything unsound about the 727 planes, but many pilots didn’t fully understand how to operate the new flaps — arguably a parallel to the MCAS situation with the 737 MAX — which spurred some additional training and changes to the operation manual. Passengers avoided the planes for months, but eventually came back as there were no more crashes, and the 727 went on to fly safely for decades. Boeing hopes to have a similar happy ending to this saga, but so far they seem to be a long way from that point. And their immediate future likely involves more tough questions.

The 737 MAX was briefly a topic of political controversy in the United States as foreign regulators grounded the planes, but President Donald Trump — after speaking personally to Boeing’s CEO — declined to follow. Many members of Congress (from both parties) called on him to reconsider, which he rather quickly did, pushing the whole topic off Washington’s front burner.

But Trump is generally friendly to Boeing (he even has a Boeing executive serving as acting defense secretary, despite an ongoing ethics inquiry into charges that he unfairly favors his former employer) and Republicans are generally averse to harsh regulatory crackdowns. The most important decisions in the mix appear to have been made back during the Obama administration, so it’s also difficult for Democrats to go after this issue. Meanwhile, Washington has been embroiled in wrangling over special counsel Robert Mueller’s investigation, and a new health care battlefield opened up as well.

That said, on March 27, FAA officials faced the Senate Commerce Committee’s Subcommittee on Aviation and Space at a hearing called by subcommittee Chair Ted Cruz (R-TX). Cruz says he expects to call a second hearing featuring Boeing executives, as well as pilots and other industry players. Cruz was a leader on the anti-Boeing side of the Export-Import Bank fight years ago, so perhaps is more comfortable than others in Congress to take this on.

When the political system does begin to engage on the issue, however, it’s unlikely to stop with just one congressional subcommittee. Billions of dollars are at stake for Boeing, the airlines who fly 737s, and the workers who build the planes. And since a central element of this story is the credibility of the FAA’s own process — both in the eyes of the American people and also in the eyes of foreign regulatory agencies — it almost certainly isn’t going to get sorted out without more involvement from the actual decision-makers in the US government.
